Addventure Tours – Terms and Conditions of booking

1. Booking Contract

1.1  Contract – Your booking contract will be with Addventure Tours LTD.(Company number 11404949) ‘ Addventure Tours’ (‘our’ ‘we’ “us’). By submitting your booking form, you accept and agree to our Terms and Conditions below.

1.2 The contract is considered active as soon as the form has been submitted. The group leader takes full responsibility for all members of the group and that the group make payments on time. The group leader is responsible for informing Addventure Tours of any changes.

1.3 It is not possible to make a booking with out filling out the booking form.

2. Booking Conditions

2.1 Deposit and Balance – Addventure Tours require a holiday deposit of £100 per person. This is due at the time of submitting the booking form. Your holiday package booking is not considered complete until this deposit has been received in full. The full balance payment is due no less than 6 weeks before your arrival date. Should Addventure Tours not receive your balance payment with in this time frame, we reserve the right to cancel your holiday package with no deposit refund. Note. You will receive a reminder when your balance is due.

2.2 Booking Changes – Addventure Tours reserve the right to charge for any changes made to your booking.

2.3 Booking cancelation by group leader –  Any cancelations must be received by Addventure Tours in writing either by Email or Post. No refund will be provided for  cancelations made within 28 days of the arrival date. Cancellations made more than 28 days before arrival will receive a refund of 50% of the booking price.

2.4  Cancelation by Addventure Tours. – Addventure Tours reserve the right to cancel your holiday package booking at any time with a full refund or an offer of an alternative package.

2.5 Pricing Variables – We reserve the right to change our pricing at any time. We will not however make any price changes after you have received a confirmation invoice.

2.6 Alterations to your package by Addventure Tours – Addventure Tours reserve the right to make minor changes to your package. As your package is booked well in advance, it may be necessary for minimal changed to be made. We will notify you of any changes. If for any reason there is a larger change, you can choose to 1) Accept the chance, 2) Choose an alternate package, 3) Cancel you booking.

2.7 Cancelations due to Corona Virus – You will receive a full refund if your trip is forced to be cancelled due to the inability to travel to Poland  – This means that if either the Polish or UK/Home Country’s governments block travel between the two countries. 

All other cancellations due to Corona Virus within 28 days of arrival will be non refundable.

3. Liability

Addventure Tours does not accept any liability in the following circumstances:

3.1 Any unforeseen event resulting in Force Majeure (outside the control of Addventure Tours) such as, but not limited to; war, civil unrest, political unrest, acts of god, weather, technical disasters, epidemics, quaranteen restrictions and industrial disputes.

3.2 Any disruption, cancellation, delay or charges caused by weather to any guest for the duration of your stay such as, transport delay, avalanche, mud slides, floods, fires. As well as the effect that this may have on the rest of your package – Accommodation, activities and transportation.

3.3 Limitations imposed by local authority, resort staff, local ski school, rental shops and drivers.

3.4 Any extra activities, transport or flights that are not arranged by Addventure Tours

3.5 Any personal injury, illness or death caused to a group member for the duration of your stay. Any proceedings will be governed by English Law

3.6 Any person who is not named in writing as a member of the group before arrival and there for not a party to this contract has not right to enforce any term of the contract.

4. The responsibilities of Addventure Tours

4.1  Safety – Addventure tours organise your activities, transport and accommodation with your safety in mind and have complete discretion to vary or cancel any part of your package should we deem anything to no be 100% safe.

4.2 Flights –  Addventure tours’s clients are responsible for their own flights. We do not take any responsibility for flight delays, diversions or cancelations as well as any transport problems caused by these scenarios. Addventure Tours will help and advise you on the best flights available if you require. Should your flight be cancelled or delayed you must notify us as soon as possible. Should your flight be cancelled or delayed ( more than 3 hours) you may incur further transport charges from Addventure tours.

4.3 Airport transfers – Addventure Tours will do our best to get you to the airport on time for your flight however we can not be held responsible for any circumstances that lead to missed departures. Punctuality can not be guaranteed due to bad weather or unforeseen circumstances.

4.4 Ski lift passes – Unless otherwise stated by Addventure tours, your daily lift pass will be valid at Bialka Tatrzanksa for 6 hours from the first use. Pick up and departure times are decided by Addventure tours and you will be advised on this by a member of staff on a day by day basis. You will have a minimum of 6 hours at the slopes.

4.5 Sports Equipment Hire – Loss or damage to any hire equipment is entirely your responsibility. Addventure tours takes no responsibility for any charges incurred. Charges must be paid to the rental shop directly before departure. It is the responsibility of the guest to remember his/her equipment.

4.6 Responsibilities, damages and behaviour – Should any guest damage any property of Addventure Tours LTD or the property of the accommodation or transport used he or she will be required to pay the full retail price of the damages. Failure to do so will result in legal action and the termination of the holiday package for the whole group.

Should any guest be adjudged to act in an antisocial manner towards any member of staff, Addventure tours guests or guest of the accommodation that you stay in, Addventure tours reserve the right to terminate your package without a refund or compensation to their loss of holiday.

5.Law and Jurisdiction

5.1 Your Contract – Your contract with Addventure Tours ltd is governed by English Law and all claims will be in the jurisdiction of the English Courts

5.2 Complaints – Out aim is to deal with any complains straight away. If you have a complain please – speak to a member of management as soon as possible in resort. Alternatively please contact us in writing to our Uk office address with in 28 days of your return.
